Terms of service

1. Who we are

These terms are an agreement between you and Applifyer, LLC, a Delaware limited liability company at 131 Continental Dr, Suite 305, Newark, DE 19713, USA, referred to as “Fjalim” or “we”. They cover the Fjalim service at fjalim.com, app.fjalim.com and api.fjalim.com.

2. The service

Fjalim turns Albanian speech in audio and video files into text. You can use it through the web app and the API. It also includes editors for transcripts and captions.

Transcripts are produced by software and can contain mistakes. Check anything that matters before you rely on it. A Fjalim transcript is not a certified or sworn transcript.

Real-time transcription is planned. It is not part of the service today.

3. Your account

You need an account to use the app and the API. You must give a correct email address and keep your password and API keys secret. You are responsible for what happens under your account.

You must be at least 18 years old, or be acting for a business. The free 15 minutes are given once per person, after you verify your email.

4. Credit and payment

Fjalim is prepaid. Batch transcription costs €0.012 per minute, billed per started second. You add credit in whole euros, at least €10 and at most €1,000 per purchase, through Stripe Checkout.

Credit is valid for 24 months from the day you buy it. Refunds are described on the refunds page. Prices are in euros and exclude applicable taxes, which are added at checkout where required.

We may change prices. A change applies to credit you buy after it takes effect, and we tell account holders by email before it does.

5. Your content

You keep all rights to your audio, video and transcripts. You give us permission to store and process them only to provide the service to you.

You promise that you have the right to upload your content and that you have a legal basis, including any consent that people in the recording must give.

We do not train models on customer audio without your permission. See the privacy policy and the data retention page.

6. Acceptable use

You must follow the acceptable use rules.

7. Availability

We work to keep Fjalim running, but we do not promise that it will always be available or free of errors. We may take it offline for maintenance. The service is provided “as is”, to the extent the law allows.

8. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for intent, gross negligence, injury to a person, or rights you have as a consumer.

Subject to that, our total liability to you for any claim about the service is limited to the amount you paid us in the 12 months before the event. We are not liable for indirect loss, such as lost profit, or for decisions you make based on a transcript.

9. Ending the agreement

You can close your account at any time. You can delete your transcriptions at any time.

We may suspend or close an account that breaks these terms or the acceptable use rules, after warning you where that is practical. If we close your account for a reason other than your breach, we refund your unused credit.

10. Changes to these terms

We may update these terms. For material changes we email account holders at least 30 days before they apply. If you do not agree, you can close your account and ask for a refund of unused credit.

11. Governing law and disputes

These terms are governed by the law of the State of Delaware, USA, and disputes go to the courts in Delaware, USA. If you are a consumer, you keep the mandatory protections of the law of your country of residence, and nothing in these terms takes them away.
